GX Rewards Terms and Conditions

1. Organizer and Program. The GX Rewards (“Program”) is a free to enter reward program organized by Opera Norway AS, an entity organized under the laws of Norway, with a registered address at Vitaminveien 4, NO-0485 Oslo, Norway (“Opera” and “we,” “us,” and “our”) in cooperation with third party partners (“Partners”).
   
   The Program is enabled by default if participant downloads and installs Opera GX browser using a dedicated GX Rewards Promotion website, otherwise it might be enabled manually by using the option provided in settings in Opera GX browser's menu.
   
   Within the Program you may participate in rewards experiences related to Overwatch 2 and Overwatch Esports (“Reward Experiences”) and earn incentives as available per each Reward Experience (“Rewards”). Rewards under a Reward Experience are issued to you as unique alphanumeric codes (“Codes”), which you then redeem yourself on your Battle.net account.
2. Agreement and Terms and Conditions. These GX Rewards Promotion Terms and Conditions (“Terms”) form a legally-binding contract between you and Opera. By participating in the Program, you agree that you have read, understood, and are bound by these Terms. Please read the Terms carefully. You further agree that all decisions of Opera shall be final and conclusive. If you do not agree to these Terms, you may not participate in the Program.
3. Eligibility. The Program is available only for participants who:
   
   a. are residents of the qualifying countries;
   b. have downloaded and installed Opera GX browser and use only one instance of Opera GX browser for participation in the Program;
   c. have a Battle.net account and use only one Battle.net account for participation in the Program; and
   d. accept these Terms.
   
   Employees of Opera Norway AS, its affiliates, advertising or promotion agencies, those involved in the production, development, implementation, or handling of these programs, and the immediate family members (spouse, parents, siblings, and children) and household members of such employees are not eligible. All local federal, provincial, and municipal laws and regulations apply. Void where prohibited by law.
4. Requirements. To participate in the Program you must:
   
   a. download and install Opera GX browser (unless you already have);
   b. have a valid Battle.net account, which you will need in order to redeem any Code you claim;
   c. accept these Terms by clicking the call-to-action button; and
   d. set Opera GX as your default browser and keep it set as your default browser at the time you claim a Reward.
   
   You may participate in every available Reward Experience of your choice. Please note that Reward Experience might be time-limited at Opera's sole discretion. Within each Reward Experience, Rewards unlock one at a time and in sequence. The waiting period before the next Reward unlocks starts when you claim the preceding Reward — it does not run automatically with the passage of time. If you do not claim a Reward, the sequence does not advance and no further Reward will unlock for you. Depending on when you start and how regularly you claim, you may not be able to claim every Reward in a Reward Experience before that Reward Experience or the Entry Period ends, and any Reward you have not claimed by then is forfeited.
5. Rewards. Rewards are stipulated in each Rewards Experience description or showcases. The Rewards pool is not limited.
   
   Rewards you have earned are subject to the following conditions:
   
   a. Rewards are issued to you as Codes and may only be redeemed via your Battle.net account, subject to Blizzard Entertainment's applicable terms;
   b. Codes are personal to you and non-transferable. Codes may not be sold, offered for sale, auctioned, traded, bartered, exchanged for cash or other value, gifted, redistributed, bulk-collected, or published or otherwise shared publicly, including on any website, marketplace, social platform, giveaway or code-sharing service;
   c. each Code may be redeemed once only. Once a Code has been redeemed it cannot be reissued, and Opera is not responsible for a Code that is redeemed by another person after you have disclosed, shared or published it;
   d. Opera may void, cancel or deactivate any Code that has been obtained, used, transferred or offered in breach of these Terms, or that Opera reasonably suspects to have been, and may exclude the participants involved from the Program, without compensation;
   e. Codes must be redeemed before the expiry date communicated to you with the Code or, where no such date is communicated, before the end of the Entry Period. Rewards and Codes have no cash value and are not refundable or exchangeable. Opera may, at its discretion, replace a Code that was invalid or non-redeemable at the time it was issued to you;
   f. In some cases Rewards may expire or become unavailable, e.g. the game or in-game content offered by the Partner of a Reward Experience may be shut down, withdrawn or otherwise expire, and in such a case you will lose access to the Rewards claimed within such game.
   
   You will not earn Rewards if we determine in our sole discretion that: (i) you have abused IT systems to claim Rewards, or affect the integrity, confidentiality, or availability of the Program data in any way; (ii) you attempted to circumvent any of the security mechanisms of the Program; (iii) you did not meet all Program conditions, including but not limited to eligibility requirements.
6. Entry Period. The Program start date is [• start date] and the Program ends on [• end date] (the “Entry Period”). Rewards must be claimed, and Codes redeemed, within the Entry Period, unless a different redemption deadline is communicated to you with the Code.
7. Data Processing. Please note that Opera will be processing your personal data for the purposes of performing this Program, including operating the Program, verifying your eligibility, allocating and issuing Codes to you, and detecting and preventing fraud or abuse of the Program. Opera does not require your Battle.net account name or credentials in order to issue you a Code, and Opera does not redeem Codes on your behalf: redemption takes place directly between you and Blizzard Entertainment on your Battle.net account and is governed by Blizzard Entertainment's own terms and privacy practices. 8. Miscellaneous
   
   a. Modifications. We reserve the right to modify, suspend, or terminate the Program at our discretion. This includes, but is not limited to, altering the requirements, Rewards and Program structure. Any changes to these Terms will be communicated via Program.
   
   b. Third Party Platforms. Overwatch 2, Battle.net and related names and logos are the property of Blizzard Entertainment, Inc. Redemption of Codes and access to the Rewards require an active Battle.net account and may depend on your Battle.net region, your platform and the status of your account. Opera does not control and is not responsible for the availability, operation, content or terms of Battle.net or Overwatch 2, or for any Reward being unavailable to you as a result.
   
   c. Release and Limitations of Liability. By participating in the Program, you agree to release and hold harmless Opera, and/or its suppliers from any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including without limitation, damages for loss of use, data, or profits, arising out of participation in these programs or receipt or use of any reward or prize. This includes but is not limited to: (a) unauthorized human intervention in the programs; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) errors in the administration of the programs or processing of entries; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation or receipt of any reward.
   
   You further agree that in any cause of action, Opera's liability will be limited to the cost of entering and participating in the programs, and in no event shall Opera be liable for attorney's fees or costs. You agree to indemnify and hold Opera, its parents, subsidiaries, affiliates, officers, and employees harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of participation in the programs.
   
   d. Contacting support. You may address support requests, or any other incident or complaint to our customer service team via the support channel.
   
   e. Governing Law and Jurisdiction. These Terms are based on Norwegian law. These Terms are governed by the laws of Norway without giving effect to any conflicts of law principles that may require the application of the laws of a different country. All actions or proceedings arising under or related to these Terms must be brought in the Oslo City Court, and each party hereby agrees to irrevocably submit to the jurisdiction and venue of any such court.
   
   f. Notice. Users from:
   
   - China, Russia, Belarus;
   - the UN, FATF, or MAS-sanctioned countries are excluded from participation in this Program without exception.
